ML Embroidered Memories Terms & Conditions, Payment and Security

 

1. Introduction

Welcome to ML Embroidered Memories ("ML Embroidered Memories," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of our website  and the purchase of our embroidered artwork and related services (collectively, the "Services").

2. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the Services.

3. Artwork Ownership and Use

3.1 Embroidery Files:

Marieke Lubach van Hensbergen is the artist and retains ownership of the digital embroidery files used to create the artwork. These files are not sold.

3.2 Artwork Purchase:

You purchase the finished artwork as displayed and selected on our website. We convert your portrait photo into an embroiderable file to create the artwork. These conversion files remain in our possession. You can request the removal of these conversion files at any time for privacy reasons.

4. Exchanges and Returns

4.1 Artwork Exchanges:

If for any reason you are not satisfied with your non-personalized or commissioned artwork, you may return it within 3 months of receipt. We offer a full refund for returned artwork, including shipping costs. All return shipping costs are covered by ML Embroidered Memories.

However, we cannot accept returns or refunds for commissioned artwork or custom designs due to their personal nature.

4.2 Artwork Returns:

To be eligible for a refund, please contact us before returning to make proper arrangements with each other. You must use the same packaging and packing method for your returns as how you received it from us.

4.3 Return Process:

To initiate a return, please contact us within 3 months of receiving your artwork by email at [email protected].

5. Artwork Descriptions and Representations

We strive to provide accurate descriptions and pictures of our artwork on the website. However, the displayed picture is not a binding representation of the final artwork. We can send you additional pictures upon request.

6. Order Processing and Shipping

Once your payment is complete, your artwork will be reserved for you. Standard artwork typically ships within a reasonable timeframe. Commissioned artwork may take 5-10 weeks to complete, depending on complexity. You can only cancel an order if the artist has not yet begun working on it. We will notify you when work begins.

Production time for commissioned pieces will be added to the standard shipping timeframe. Shipping time may vary depending on your location and any additional services like framing.

We will provide you with a tracking link via email 2-3 days after your purchase to track your order. We use third-party shipping services. Delivery times and options may vary. We will send you tracking information from our third-party delivery service. Shipping costs are not included in the artwork price and are calculated based on your location. All taxes and customs fees are included in the price of the artwork.

In rare cases, the shipping company may require additional import duties. If this occurs, you may prepay the duties and share a receipt with us for a full refund.

7. Payment

Severall Payment methods are available thrugh the invoice or shop.

We confirm that all third party(s) handling storage, processing, and/or transmission of cardholder data are PCI DSS compliant.

We do not electronically store, process, or transmit any cardholder data on our systems or premises, but rely entirely on a third party(s) (Mollie and/or Multisafepay) to handle all these functions.

All elements of all payment pages delivered to the consumer’s browser originate only and directly from a PCI DSS validated third-party service provider(s)

8. Privacy / Security Policy

We respect your privacy and are committed to protecting your personal information. We will delete all your stored information when asked for (by mail).

All system components and software are protected from known vulnerabilities by installing applicable vendor-supplied security patches.

Critical security patches are installed within one month of release.

9. Modifications to the Terms & Conditions

We reserve the right to modify these Terms at any time without prior notice. We will post any changes to the Terms on this page. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
